The Claimant suffered a moderately severe traumatic brain injury when he was knocked off his bicycle in a road traffic collision.
In addition to the neurocognitive effects of his TBI, the Claimant also suffered right-sided homonymous hemianopia (HH), which resulted in a significant loss of vision affecting the right side of each eye.
At approximately 9 months post-accident, there had been some modest improvement in the Claimant’s vision, but formal testing showed that he was still experiencing significant loss of visual field and blurred vision, and his day-to-day visual function was assessed at only 57% of normal.
As a consequence, the Claimant was certified as visually impaired and assessed as medically unfit to drive a motorcar.
With the further passage of time, however, the Claimant made “a remarkable recovery” from both his cognitive impairment and HH and by approximately 17 months post-accident he had recovered 85% of normal visual function and was able to satisfy the visual requirements to be passed fit to drive.
