Tim Grover has settled a moderate-severe traumatic brain injury case on behalf of a claimant motorcyclist for £3.5 million on a provisional damages basis.
Liability for the road traffic accident giving rise to the claim had previously been compromised on an 80:20 basis in favour of the claimant.
Accordingly, the full liability value of the claim, which included contested claims for future loss of earnings, future case management, future therapies, future care and assistance, future professional deputyship costs (capacity was in issue) and the future additional cost of accommodation, would have been in the region of £4,375,000.00.
The settlement was approved in the High Court on the agreed basis that the Claimant would be entitled to claim further damages from the defendant in the event that at some future time he was to develop epilepsy which could not be controlled by medication.
