Gary Reynolds successfully represented a Registered Provider of Social Housing in a housing conditions claim. The claim was dismissed and the Defendant made an application for the claimant’s solicitor to pay the costs of defending the claim.
A Judge in Birkenhead County Court found that the well known Housing Disrepair Solicitor “had acted improperly, unreasonably and negligently”. The Judge ordered the solicitor to pay the defendant’s substantial costs of defending the action and the costs proceedings.
Gary predicts that as a consequence of the very high number unmeritorious housing condition claims being brought on behalf poorly represented tenants such orders are likely to become more common place.
